Driving in India: key facts

Do you need an International Driving Permit in India?

India requires the treaty document, not the foreign national licence. The Ministry of Road Transport and Highways FAQ asks: "Can an NRI/foreigner drive a vehicle in India on the basis of European license or driving license issued by any foreign country?" and answers: "He can not. However, if he has obtained an IDP from his own country and his country is a signatory to the 1949 Geneva Convention, he can drive in India the specified category of vehicle till the IDP is valid." That FAQ is genuine, but the page is no longer published on morth.gov.in (the cited PDF path now returns the ministry's homepage shell) and the archived copy carries a 2011 footer, so it is treated here as archived government guidance rather than current guidance. It is corroborated by the current UK FCDO advice for India: "You'll need to have both the 1949 version of the international driving permit (IDP) and your UK driving licence with you in the car." The legal architecture behind it is: Motor Vehicles Act 1988 s.3(1) requires an "effective driving licence issued to him", and s.2(10) defines "driving licence" as "the licence issued by a competent authority under Chapter II" of the Indian Act, so a foreign national licence is not in itself an effective licence; Article 24(2) of the 1949 Geneva Convention expressly permits this, providing that "A Contracting State may however require that any driver admitted to its territory shall carry an international driving permit conforming to the model contained in annex 10". Carry the IDP and the original national licence together; the IDP is only a translation and is void without the licence it is based on.

How long can you drive in India with a foreign licence?

For as long as the 1949 IDP is valid, and no longer than one continuous year in India. Two separate caps apply: (1) a 1949-model IDP is issued "for the period of one year from the date of issue" (Convention, Annex 10), and (2) Article 1(2) of the Convention provides that "No Contracting State shall be required to extend the benefit of the provisions of this Convention to any motor vehicle or trailer, or to any driver having remained within its territory for a continuous period exceeding one year." Beyond that you need an Indian driving licence. The underlying national licence, the immigration stay and the vehicle category must all remain valid throughout. India is a Contracting Party to the 1949 Geneva Convention on Road Traffic, but not to the 1968 Vienna Convention.

Why acceptance of your licence varies from place to place

Whether a foreign country accepts your driving licence hangs on a tangle of variables: three different road-traffic conventions signed decades apart (1926, 1949, 1968) — the oldest predates the United Nations itself, and only the latter two were concluded under it — countries at different stages of joining each (signed vs. accepted vs. ratified), licences printed in alphabets local police can't read, vehicle-category systems that don't line up between countries, document generations that may not meet a convention's format even when the country is a member, bilateral deals between individual states, and local laws that are looser in one place and stricter in the next. The same licence can be fine at one border and rejected at the next — even at the next rental desk. The International Driving Permit exists to cut through most of it: a standardized, multilingual presentation of your existing licence, with harmonized category symbols, that most officials can read at a glance. It doesn't replace your national licence or grant new rights — you carry both — and it doesn't guarantee acceptance: a handful of destinations still require a local permit alongside or instead of it, but for most it meaningfully improves your odds.

The rule in each state or union territory

India is the case where the licence rule does not vary, and saying so is the point. The Motor Vehicles Act 1988 is central legislation; no state or union territory can rewrite who may drive on what document, and none has. The national rule is stricter than most visitors expect: a foreigner may not drive on a foreign national licence at all, and needs an International Driving Permit issued by a country party to the 1949 Geneva Convention, valid one year or until the home licence expires. India issues such permits only to its own citizens, so it cannot be obtained after you arrive. What does vary is whether a foreigner may lawfully be in a place at all — Arunachal Pradesh, Nagaland, Manipur, Mizoram, Ladakh, the Andaman and Nicobar Islands and Lakshadweep require a permit before a foreigner may enter at all, and Sikkim, Himachal Pradesh and Uttarakhand close zones rather than the whole territory. There the permit, not the licence, is what stops a journey.

Can you drive in India with your country's licence?

This table is for tourists and temporary visitors. Moving to India as a resident? Different rules apply — see the residents section below. Find your licence's country of issue below. India runs a strict treaty-document regime: a foreign national licence is never enough on its own. Under the Motor Vehicles Act 1988 a "driving licence" means one issued under Chapter II of that Act, so a foreign licence is not an effective licence - and Article 24(2) of the 1949 Geneva Convention expressly lets a state require every admitted driver to carry an International Driving Permit. Bring a valid 1949-model IDP issued by a 1949 Convention country together with your original national licence, and drive only the categories the IDP shows. There is no EU exception, no translation route and no English-language shortcut. The route runs out after one continuous year in India, after which an Indian licence is required. Where to get an International Driving Permit

An International Driving Permit must be obtained before you travel, and only certain countries may issue one to you — you cannot buy an official IDP from an unrelated country. Under the 1968 Vienna Convention it may be issued only by the Contracting Party where you normally reside and which issued or recognizes your licence — by that Party's competent authority or by an association it has duly empowered. Under the 1949 Geneva Convention it is issued by the competent authority of a Contracting State, or by an association that authority has duly empowered. Which body that is varies by country: a government agency in some, an authorized motoring club in others.

• Travelling from India? India's official IDPs are issued by State/Regional Transport Offices (RTOs) under MoRTH — applications are accepted online. Official site.
• Travelling from another country? Ask that country's driving-licence authority which body it authorizes to issue IDPs — a government agency in some countries, an authorized motoring club in others.

Separately, IDA offers a digital International Driver's Document — a translation of your national licence that you carry alongside it. It is not an International Driving Permit issued under the 1949 or 1968 conventions by the body your country authorizes for that purpose, and it is not a certified, sworn or otherwise official translation: no authority certifies it, and where a country requires an official or certified translation by law, our document does not satisfy that requirement. It is a private translation meant to make your national licence readable at rental desks and roadside checks.

Moving to India? Rules for new residents

The IDP is a visitor mechanism only. Once you stop being a visitor - and in any event past one continuous year in India - you need an Indian driving licence issued by the state or union-territory licensing authority through the Sarathi/Parivahan system. Official source.

Driving rules in India tourists get fined for

• Mandatory equipment: Seat belts (section 194B) and motorcycle helmets (sections 129, 194D) are compulsory. The vehicle must carry valid registration, insurance and a pollution-under-control certificate. Note: the first-aid kit, warning triangle and chock blocks specified in the Central Motor Vehicles Rules are an obligation on the manufacturer to supply "at the time of first sale of vehicle" and apply mainly to transport and goods vehicles - they are not a general carriage duty on a private driver.
• Drink-driving: Motor Vehicles Act 1988 s.185(a) makes it an offence to drive or attempt to drive with "alcohol exceeding 30 mg. per 100 ml. of blood detected in a test by a breath analyser, or in any other test including a laboratory test" - i.e. 0.03 g/dl. s.185(b) separately covers driving under the influence of a drug. First s.185 offence: "imprisonment for a term which may extend to six months, or with fine of ten thousand rupees, or with both". Second or subsequent offence: up to two years, or a fine of fifteen thousand rupees, or both. The 2019 amendment deleted the former qualifier "if committed within three years of the commission of the previous similar offence", so any later offence counts as subsequent regardless of gap.
• Speed limits: No single national limit. Limits depend on vehicle class, road and state or local notification under s.112, and are set by posted signs. Follow the lowest applicable posted limit.
• Carry the original national licence, the original 1949 IDP, passport and visa or stay evidence, plus the vehicle's registration certificate, insurance certificate and pollution-under-control certificate. s.130(1) of the Act obliges a driver to produce the licence on demand by a police officer in uniform.
• Traffic keeps left. There is no single national speed limit: s.112 fixes limits by Central Government notification for classes of vehicle, and states or authorised authorities set maxima and minima "by notification in the Official Gazette, and by causing appropriate traffic signs to be placed". Follow the lowest applicable posted limit; never treat a headline national figure as permission.
• Riding without a helmet or driving without a seat belt is an enforced offence, not a matter of advice. s.129 requires protective headgear for "Every person, above four years of age, driving or riding or being carried on a motorcycle", with an express proviso exempting a Sikh wearing a turban; s.194D fines 1,000 rupees plus a three-month licence disqualification. s.194B fines 1,000 rupees for driving without a safety belt or carrying passengers not wearing seat belts.
• Road conditions, mixed traffic and enforcement intensity vary greatly between states and between urban and rural roads. Avoid night driving outside major corridors where practical, and check monsoon, mountain-pass and inner-line/protected-area permit conditions before setting out. Many visitors hire a car with a driver instead of self-driving.
